By becoming a HSC, you agree to abide by our Terms and Conditions of Use (“Services”), this Privacy Policy, and acknowledge that sharing your Healthful Story or Data™ is at your sole discretion.

Key Definitions

1. Public Areas: The Services include functionality that allows Users to upload Content, blogs, message boards, Ask an Expert, forums, and other public areas (collectively “Public Areas”). Please remember that the content you choose to share in Public Areas will be available to the other Healthful Members™ and the potentially the General Public. Accordingly, please consider carefully what content you choose to share while using the Public Areas. Do not share private information in Public Areas. By submitting content to Public Areas, you agree that submissions to Public Areas are non-confidential for all purposes.
2. Aggregate Information: information that has been combined with that of other Healthful Members™ and analyzed or evaluated as a whole, such that no specific individual may be reasonably identified.
3. De-identified Information: information that has been stripped of your Registration Information (e.g., your name and contact information) and other identifying data such that you cannot reasonably be identified as an individual, also known as pseudonymized information.
4. Healthful Story™: A Healthful Story or Data™ is defined as any content provided by submitting, displaying, posting, and otherwise sharing or using the Services and will typically include, but is in no way limited to, a detailed recall-based chronicle of your background and experience from initial symptoms, through to diagnosis, and treatment for one or more health conditions or illnesses. A Healthful Story or Data™ may either be submitted directly to JoinHealthful.com and HealthfulData.com via a Healthful Member™ or collected via a Healthful Assessment™. Your content might include text, files, documents, reports, results, information, bulletins, images, photos, video, works, works of authorship, applications, or any other materials. You control what content you choose to share with other Users of the Services. Your use of the Services, including what content you share, is always voluntary.
5. Healthful Member™: These are individuals who have voluntarily registered to share their Healthful Story or Data™ with the public via www.JoinHealthful.com and HealthfulData.com or by participating in one of our Healthful Assessment™.
6. Healthful Assessments™: These are assessments that are conducted by JoinHealthful.com and HealthfulData.com with the express purpose to capture, chronicle, and publish complete Healthful Data™ online or in anonymized report form. These assessments may also be analyzed in aggregate and data in aggregate report form may either form the basis of products for sale by HDI to healthcare providers, policy-makers, drug and/or device manufacturers, and/or other healthcare stakeholders. The aggregated analyses may also be used to publish original scientific research as described below.
7. Individual-level Information: information about a single individual’s Healthful Story or Data™, diseases or other traits/characteristics, but which is not necessarily tied to Registration Information.
8. Personal Information: information that can be used to identify you, either alone or in combination with other information. HDI collects and stores the following types of Personal Information:

• Registration Information: information you provide about yourself when registering for and/or purchasing our Services (e.g. name, email, address, user ID and password, and payment information).
• Self-Reported Information: information you provide directly to us, either through the Services or through a third party, including your disease conditions, other health-related information, personal traits, ethnicity, family history, and other information that you enter into assessments, surveys, forms, or features while signed in to your Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com account or participating in a Healthful Assessment™.
• Sensitive Information: information about your health, and certain Self-Reported Information such as racial and ethnic origin, sexual orientation, and political affiliation.
• Member Content: information, data, text, software, music, audio, photographs, graphics, video, messages, or other materials – other than Self-Reported Information-generated by Members to HDI Services and transmitted, whether publicly or privately, to or through HDI.
• Inferences and Derived Data: information, data, assumptions, or conclusions that are derived directly or indirectly from another source of Personal Information. For example, we may use statistical techniques to infer additional information.
• Web-Behavior Information: information on how you use our Services collected through log files, cookies, web beacons, and similar technologies, (e.g., device information (device identifiers), IP address, browser type, domains, page views).

At JoinHealthful.com, Thrive.JoinHealthful.com, and HealthfulData.com, we believe that sharing your information as a Healthful Story™ is at your sole discretion. If you do not feel comfortable sharing information and/or are concerned about your information being made accessible to the public, do not share it. Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com is not liable for information that you share.

We do value the privacy of our members and will take reasonable precaution to remove any information that you do not wish to have made public should you provide us with sufficient written notification. We are committed to removing any content you would like removed within a reasonable timeframe.

Consent for Storing Your Healthful Story or Data™

By choosing to contribute your Healthful Story or Data™ to Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com, you are consenting to having Healthful Data, Inc. and its contractors / third party partners access to and analyze your stored Healthful Story or Data™, in a manner consistent with our Terms of Service and Privacy Statement. Unless we notify you otherwise, we will store your information indefinitely. We may contact you in the event we need further information regarding your Healthful Story or Data™.
All content submitted to or available through the Services is the sole responsibility of the Healthful Member™ who submitted the content. Content posted or shared by other Healthful Members™ does not necessarily reflect the opinions or policies of HDI. We assume no responsibility for the content posted by any Healthful Member™ and no responsibility for the conduct of the Healthful Member™ with respect to any such content. HDI assumes no responsibility for monitoring the Services for inappropriate content or conduct, but we reserve the right, in our sole discretion, to investigate use of the Services and take appropriate action in accordance with these Terms. Other Healthful Members™ may alert us to inappropriate use of the Services, including inappropriate content or conduct.
You agree to ensure that any content you share using the Services is yours to share, and that you are not violating the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. Keep this in mind because you are responsible for any rights clearance for any content you post or otherwise share.

One of the missions of Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com is to make and support meaningful healthcare discoveries by enabling HDI customers to participate directly in research. JoinHealthful.com, Thrive.JoinHealthful.com, and HealthfulData.com seeks to collect and publish via anonymized aggregate reports and may conduct directly, or through partners, research specifically to support scientific publication which we call Healthful Research™. Specifically, Healthful Research™ refers to research aimed at publication in peer-reviewed journals and research funded by the federal government (such as the National Institutes of Health – NIH). Healthful Research™ may yield insights to policy-makers, healthcare providers, and others that helps to:

• Discover environmental or behavioral factors behind diseases and traits
• Uncover connections among diseases and traits
• Learn about gaps in the current healthcare system that might be fixed by policy changes and/or efforts by providers, life science companies, and others

The collection of some Healthful Data™ may occur in the form of assessments that may be sponsored by or conducted on behalf of third parties, such as non-profit foundations, academic institutions or pharmaceutical companies.
Your Healthful Story or Data™ may cover potentially sensitive topics such as sexual orientation, illicit drug use or other illegal behavior, or HIV/AIDS status. When Healthful Data, Inc. conducts assessments on such sensitive topics, we may provide additional information to help you decide whether you want to participate in research on these topics.
Research is an important aspect of our Healthful Services™ and we want to ensure interested participants are aware of additional opportunities to contribute to interesting, novel scientific research conducted by academic institutions, healthcare organizations, pharmaceutical companies, and other groups. If you have chosen to participate in Healthful Research™, from time to time we may inform you of third party research opportunities for which you may be eligible. For example, if a university tells us about a new cancer research project, we may send an email to Healthful Research™ participants who potentially fit the relevant eligibility criteria to make them aware of the research project and provide a link to participate with the research organization conducting the study. We will not share Individual-level Self-Reported Information with any third party without your explicit consent. If you do not wish to receive these notifications, you can withdraw at any time by written notification to contact@healthdata.com.
We value your feedback and may send you assessments, surveys, polls, or requests for testimonials to improve and optimize our Services. You are in control of the information you would like to share with us. By creating a Healthful Member™ account, you are agreeing that we may send you product and promotional emails or notifications about our Services, and offers on new products, services, promotions or contests. You may also opt-in to receiving similar notifications on the websites or mobile application(s). One of Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com’s missions is to make meaningful scientific contributions by enabling Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com members to participate in scientific research via assessments. If Healthful Data, Inc. publishes study results in peer-reviewed journals, there may be an indirect benefit to you as scientific knowledge increases and/or new drugs or tests are developed.
You may also have the opportunity to acquire one or more of the following, in return for some level of participation in the research:

• Comparison of your personal assessment responses to those of all responders
• There may be additional benefits to participation that are currently unforeseeable

Based on the results of analyzing your Healthful Story or Data™ along with those of others, HDI may develop intellectual property, including but not limited to patents, copyrights and trademarks, and/or HDI may commercialize products or services, directly or indirectly. In such cases you will not receive any compensation.

Risks:

There are some potential risks to contributing your Healthful Data or Story™ to Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com or HDI, as described below.

• Some assessment questions or data comparisons may make you or your family members uncomfortable.
• Your assessment responses, and/or personally identifying information may be stolen in the event of a security breach. In the event of such a breach, if your data are associated with your identity, they may be made public or released to insurance companies, which could have a negative effect on your ability to obtain insurance coverage. Although HDI cannot provide a 100% guarantee that your data will be safe, HDI will take reasonable precaution to limit the possibility of a breach.
• As with any online service, if you disclose your account password to others, they may be able to access your account and your Self-Reported Information.
• There may be additional risks to participation that are currently unforeseeable.

None of the assessments or other procedures used by HDI are invasive or experimental. The procedures involved do not involve more than the minimal risks described above.
You should be thoughtful about your sharing choices. Once you have chosen to share any Personal Information, the individuals with whom you share this information, may also use or share your Personal Information, including any Sensitive Information you choose to share.
For individuals located in the Countries Outside the US: Our legal basis for processing your Personal Information for the purpose described above is based on your consent. You may withdraw your consent at any time, however, the withdrawal of your consent will not affect the lawfulness of processing based on consent before its withdrawal.

Specifically, when creating a Healthful Member™ Profile or registering at Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com, you will be asked to use the Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com Web Portal and in the future, associated App, which are interactive software tools used to input your health and lifestyle information as part of our Healthful Mission™.

By contributing content to Thrive.JoinHealthful.com, JoinHealthful.com, and HealthfulData.com, all Members, Healthful Assessment™ Respondents, and others visiting JoinHealthful.com and HealthfulData.com agree and are legally bound to recognize that all such contributed content will be 100% owned by Healthful Data, Inc. Copyright shall be owned, without limitation, by Healthful Data, Inc. Credits in all contributions will read “© Healthful Data, Inc.” unless specified otherwise in written advance signed agreement by both the Members and Healthful Data, Inc. Royalties from the publication of any content provided by the Member to Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com and from the disposition of any subsidiary rights therein (including but not limited to films, television and merchandising) shall be 100% owned by Healthful Data, Inc. All original content provided by the Member, and the proceeds from the sale of such original content, shall remain the sole property of Healthful Data, Inc. In the case of any commercialization, no payment will be made by HDI to Members, Healthful Survey Respondents™, and others visiting Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com.
Any and all materials (which shall be treated as set forth in other provisions of this Privacy Policy and our Terms and Conditions of Use), including without limitation assessments, physician responses, suggestions, feedback, ideas, concepts, comments, illustrations and other materials that you disclose or offer to us on or in connection with this Site or any Site Materials (“Submissions”) are submitted by you without any restrictions or expectation of confidentiality. You hereby assign to HDI without additional consideration or further obligation, all rights now known or hereafter existing to use, allow others to use, or assign the right to use, the Submissions. You further agree that your Submissions may be used without restriction for any purpose whatsoever, commercial or otherwise, without compensation to you, including the right to use, reproduce, modify, adapt, publish, transmit, publicly perform or display, translate, create derivative works from, or otherwise communicate to the public the Submissions on this Site or elsewhere by us, our assigns or others we have allowed to use your Submissions. Photo, Video, Written, and Audio Release
In connection with your interaction with the Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com and HDI, provision of HDI Services, and participation in any initiatives supported by HDI, you may be required or requested to provide photos, videos and statements, participate in photo shoots, and participate in audio and video taping. Accordingly, you agree as follows:
(a) All statements, photographs, audio recordings or video recordings taken of you by HDI, its contractors or Clients, or submitted by you to HDI, its contractors or Clients, may be used by HDI, its contractors or Clients, for promotional, commercial or other purposes as determined by HDI anywhere in the world in its sole discretion. You shall not have any right to control the use or publication by HDI, its contractors or Clients, of the written or oral statements, photographs, audio recordings or video recordings.
(b) All statements, photographs, audio recordings or video recordings taken of you by HDI or its contractors, or submitted by you to HDI, shall be the sole property of HDI or its designee. You are not entitled to any compensation in connection with use of these written or oral statements, photographs, audio recordings or video recordings for promotional, commercial or other purposes.
(c) You hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the written or oral statements, photographs, audio recordings or video recordings which you may have against HDI or any person or firm authorized by HDI to publish said materials (“Publisher”). Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of HDI and any Publisher.
(d) The releases of rights described above shall be binding on your successors, heirs, assigns, executors, administrators, spouse and next of kin.

Member Eligibility

To become a Member and access the area on this Site reserved for Members (the “Member Area”), Healthful Data™ requires that you are either a (a) diagnosed patient of the particular illness for which you are providing Content or a parent or legal guardian acting for such a patient who is under 18 years of age or incapacitated, (b) caregiver for a patient eligible to contribute such content, (c) health care professional (e.g. doctor, nurse, health researcher, etc.), (d) guest with legitimate, non-commercial reasons to contribute or (e) guest as authorized by a Healthful Data™ employee.
Children under the age of 13 are prohibited from registering as Members. By becoming a Member you represent that you are age 13 or older.

Information Collected from You

When you access Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com, several types of data may be collected from you, including: (1) Non-Personal Information; and (2) Personally Identifiable Information. Certain types of data are specifically NOT collected, including financial account information and personal information from children.

• Non-Personal Information. We may automatically collect certain data regarding use of or access to the Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com and related ‘Tools’, such as:
• The type of device you use to access the Tools;
• The date and time you access the Tools;
• The type of web browser you use to access the Site; and
• The sections within the Tools that you access.
• We may also collect the IP address, user language, the operating system, the presence/absence of “flash” plug-ins, screen resolution, and connection type that you use to access the Tools.
• This information (collectively, “Non-Personal Information”) does not, by itself, personally identify users. We use this Non-Personal Information to monitor the effectiveness of the Tools, to help personalize your online experience and to consider potential improvements to the Tools. • User Authentication and Member Screening. In order to access certain restricted portions of the Site, and to access the App, you must have and login with a Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com Healthful Member account. Creation of a Healthful Member™ account (if you do not already have one) requires you to provide your name and email address as well as additional information. Please note, creation and maintenance of your Healthful Member™ account is handled by Healthful Data, Inc and is governed by this privacy policy. We may receive certain information from other sign-on or login management tools, not limited to Google, Facebook, etc. and may receive information from these entities, such as email address.
• Once you have logged in with your Healthful Member™ account, we will ask certain screening questions to determine your suitability to Contribute your Healthful Story or Data™. You will be asked to create a Healthful Member™ profile as well as share your Healthful Story or Data™ via our Healthful Assessments™ described below. You will also have the option to sign-up for our mailing list to stay informed of future opportunities to participate in research studies, which requires you to provide your email address.
• Our Healthful Assessment™. Before creating your Healthful Member Profile™, you must review both our Terms and Conditions of Use as well as this Privacy Policy that describes the type of information that we will collect when you contribute your Healthful Story or Data™, and how we will use that information. The online consent describes how, upon Contribution of your Story or Data through our Healthful Survey™, your information will be used, what information may be requested of you in the future, and how certain of this information could be shared with others outside of Healthful Data, Inc.
• Throughout the course of your status as a Member to Thrive.JoinHealthful.com, JoinHealthful.com and HealthfulData.com, you may also be requested to provide periodic health updates and to respond to certain assessments on relevant topics.
• No Personal Information from Children. We do not knowingly collect personal information from children under the age of 13. Children are not permitted to use the Tools, and we request that children under the age of 13 not submit any personal information to through the Tools. Since information regarding children under the age of 13 is not collected, we do not knowingly distribute personal information regarding children under the age of 13. For additional information, please refer to the “Children and Parents” section below.
• Other Information NOT Collected. Our services and your use of the Tools does not require you to disclose, nor require us to request or collect, any credit card or other financial account information. We do not request, solicit or intend to collect any such information and you should not disclose, enter or upload any such information through the Tools. If we discover that such information was disclosed by you, we may delete such information; however, we are not liable for any consequences relating to such disclosures of information.

Use and Disclosure of the Information Collected

The use and disclosure of certain information varies with respect to the type of information collected, including: (1) Non-Personal Information; and (2) Personally Identifiable Information.

• Use of Non-Personal Information. We use the Non-Personal Information collected through the Tools for statistical and research purposes and for improving the functionality of the Tools. This information may also be used for administrative purposes including, without limitation, to troubleshoot and resolve problems with the Tools. We may rely on third-party partners to collect and analyze the Non-Personal Information.
• Use of Personally Identifiable Information. As described above, the PII collected may be used for a variety of purposes, including responding to your requests for information, commercial product research and development, Member eligibility screening, creation of your Healthful Member Profile™ and engagement with other Healthful Members™. Your PII may be used to create a de-identified data set. We may share your PII with business partners or service providers we use to, without limitation, provide aggregated, de-identified insights to power systemic healthcare transformation per our Healthful Mission™.
• Additional Disclosures. Though we make every effort to preserve your privacy, disclosure of PII to third parties may occur in certain situations such as: (i) responding to a subpoena, court order or other such request; and (ii) responding to a law enforcement agency’s request or as otherwise required by law. In all such instances, we will take the utmost care to disclose only that information which is necessary and appropriate under the circumstances.

Use of Cookies

Cookies are small bits of data cached or stored on your computer or smartphone based on Internet activity. We may use cookies to monitor individual activity in aggregate to improve the Tools and provide features that are tailored to your needs. Your Login Information

You are responsible for maintaining the confidentiality of your member password and login, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login and password information to another person, your membership privileges may be suspended temporarily or terminated. You agree to immediately notify Healthful Data of any unauthorized use of your Member password or login or any other breach of security.

Member Termination

You agree that Healthful Data may, with or without cause, immediately terminate your Healthful Data Member™ status or limit or terminate your access to the Member Areas or the Site without prior notice. Without limiting the foregoing, the following may lead to a termination by Healthful Data of a Member’s status and use of the Site: (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated Membership cancellation), (d) unexpected technical issues or problems, and (e) extended periods of inactivity. Healthful Data has no obligation to maintain, store, or transfer to you information or data that you have posted on or uploaded to the Site.

Modifications of this Agreement

We reserve the right to modify this Agreement at any time, and without prior notice, by posting amended terms on this Site. We encourage you to review this Agreement periodically for any updates or changes, which will have an update effective date.

Disclaimer of Warranties

If you are a non-U.S. User/Member, you acknowledge and agree that Healthful Data may collect and use your Information and disclose it to other entities outside your resident jurisdiction. In addition, such Information may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for Information that is available in other countries. By providing us with your Information, you acknowledge that you consent to the transfer of such Information outside your resident jurisdiction as detailed in our Privacy Policy. If any provision of this Agreement is held to be unenforceable for any reason, the remaining provisions will be unaffected and remain in full force and effect.
